Terms and Conditions

Your initial booking and agreed day/time/venue will be agreed with you at this point. Our lessons run term time only generally in blocks of ten weeks although due to availability at some of our venues term schedules may alter slightly. Existing Swimkidz clients have priority booking which means they are entitled to book or change classes in advance of any new bookings if they are on auto-rebooking. If you do not wish to re-book the following term or change venue it is important you advise us by week 5 of your existing term. You will receive re booking instructions via a newsletter each term around week 5 of the term which details this information. 


If you wish to stop lessons and do not advise us by the deadline an administration fee of £30 will be applied for each child. If you wish to pay via BACS, payment must be received by the deadline specified otherwise you will not be guaranteed your class for next term. Once your payment has been taken, you will receive a receipt confirming the class details. If you do not want to re-book for another term you must contact us by e mail. We will confirm via e mail your request has been actioned. If we do not hear from you by the deadline, then you will be rebooked into your current class. This does not affect your statutory rights. 

  • We will not re-book you if you have opted out of auto re-booking. 
  • We will not re-book you if we need to make a change to your class. (*except in the instance of late cancellations from customers) 
  • You will not be re-booked if your BACS payment hasn’t reached us by the deadline. 
  • We will not re-book you if you email us by the deadline set. 


Class Changes - If class numbers become too small, we may need to merge classes with a similar class where possible. We will try our utmost to keep your class times as similar as possible but cannot guarantee this. We promise to give you as much notice as possible so you can consider other options. 
If you want to swap mid-term, we will try to accommodate you, but this may not always be possible, especially where you are in a small group. If there is no alternative class available for you and you wish to cancel, there will be no refund. 


Payments - When you make your initial booking you will be advised of our re-booking process. Swimkidz do not have access to full card details at any time after taking your payment. When you grant us auto-rebooking you can order products at any time and have them charged to the same card or opt to pay by another method. There is a minimum £10.00 spend to use a card. 
If you need to change the way you pay or your card details have changed, you will need to phone your area office to let them know. Should someone else be paying for lessons or products you are responsible for making them aware of the auto re-booking process and Swimkidz payment policies. 
We accept most debit and credit cards with the exception of American Express and premium business cards. Thank you for your understanding. 


Refunds and Cancellations - The Consumer Contracts Regulations 2013 do not apply to Swimkidz, however all new customers have the right to cancel 14 days after receiving these terms and conditions unless you have attended lessons. 
Any cancellations after this date and before 14 days from the start date of lessons will incur a cancellation charge of £30.00 for each booking. 
Any cancellations after 14 days from the start of term no refund will be issued. 
If the contract is agreed within the 14 days before the start of term no refund will be issued for cancelations. 
Existing clients who cancel more than 14 days before the commencement of the first day of term will be issued a refund minus a £30 cancellation charge per child (as per existing clients above).If you cancel within the 14 days before the term starts or once the term has commenced unfortunately no refund will be issued. 
Swimkidz are under no obligation to refund you for missed classes due to holidays, illness or periods of self-isolation. 
If we need to cancel your lesson due to a short-term pool issue, we will where possible re-schedule your lesson. We are not responsible for any costs incurred by you in travelling to another venue. Refunds will be credited back to your card within 7 days of the end of term; this can take 3 working days to reach your account. 
For any non-operational pool issues that last more than 7 days we will endeavour to look at alternative options for you but cannot be held responsible for guaranteeing this. If we unable to offer an alternative, you may request a refund or funds to be held on account for a new term. 
Lessons missed due to bad weather will not be refunded where the site and environment has been made safe. 
Products-refunds will be issued on the return of the product as long as it is in its original packaging and unused. 
Refunds can take up to 5 working days to reach your account. 


Photography and Videography - We all agree and appreciate that seeing your little one in the pool is truly amazing, however we must respect the wishes of others in the class and rules of the venues we use. We respectfully request that you or any family member or friend who attends with you does not use any form of photography or videography during our lessons both in and out of the pool. 
Although Swimkidz and its teachers are vigilant and enforce this rule we cannot be held responsible for actions of third parties and therefore excludes, to the fullest extent possible by law, any liability arising from a breach under this photography and videography section. 
We may at times be able to take some pictures of you and your child for parent in classes only, should you wish. We will ask you to sign a permissions form indicating if we can use these purely for Swimkidz promotional purposes. You do have the right to opt out. 


Underwater Photo Shoot - Our underwater photo shoots are generally booked at the end of each ten-week term subject to bookings. We reserve the right to re-schedule if necessary. 
Although we use state of the art photography and lighting equipment, we cannot guarantee that perfect photograph of your child due to how he/she may be feeling on the day. We use our best endeavours to ensure we seize every given opportunity to get that perfect shot but must respect the wishes of the child. Our expert team are always on hand to guide you through the shoot and make it a day to remember. 
You will get the opportunity to view your photographs shortly after the shoot and no more than 14 days. These can be offered as prints or on a USB which are offered in TIFF (high resolution large files) and Jpegs for reproduction along with a permission letter from us. Swimkidz will give permission for such reproduction and for you to post on social media sites but does not give you the right to sell images on sites such as I Stock. 
When you have placed your order, you will be asked for signed permission for Swimkidz to use your images for our promotional purposes only. You have the right to opt out. 
All photographs and logos are the copyright and intellectual property of Swimkidz, therefore any reproduction of these without our permission will be regarded as a breach of our copyright and will be managed accordingly. 


Valuables and Jewelry - We recommend that jewellery apart from wedding rings are not worn to lessons. Swimkidz cannot take responsibility for items left in lockers, changing rooms, poolside or in prams. Items such as earrings are not only a health and safety issue for you in the pool where children can pull them out causing injury, but they can get lost in the pools filtration systems. 


Medical Conditions - Swimkidz treat all information provided by you as confidential and only intended for those on a need-to-know basis. So, we can cater for any additional needs please notify us in writing or at the time of booking. 


Illness - Please consult with your medical professional if you are unsure if your illness will prevent you or your child from swimming. 
You will not be permitted if you have any of the symptoms below. 
Open wounds 
Covid symptoms 
Sickness and diarrhea (you must have had 48hrs symptom free before swimming) 
Chicken pox, ear infections, heavy colds, impetigo, conjunctivitis 


We reserve the right to refuse entry to the pool if we believe you or your child is not well enough. 
Changing Rooms & Poolside - There is a strict no eating policy both in the changing rooms and poolside. 


Contamination of the pool - Please ensure you do not feed your child at least 1.5-2hrs before they swim. This does not include baby milk, although you should try to avoid any large milk feeds within the said time. Snacking before your child enters the pool is strictly forbidden. If you suspect your child is going to vomit, please get them to the side of the pool quickly turning them away from the water’s edge. 
We reserve the right to refuse entry to the pool if there is any evidence your child has eaten prior to their lesson. Pools apply a minimum charge of £200 for cleaning the pool after sickness or faeces which could be passed on to you if the above guidelines are not adhered too. 
If you are aware that your baby has soiled their nappy, please advise the instructor so you can be assisted out of the pool to change your little one. If any faeces have entered the pool, you must alert the instructor immediately as the pool will have to be evacuated immediately. 


Nappy Policy - Swimkidz adopt a double nappy policy which consists of a reusable or paper swim nappy and a Happy Nappy over the top. This applies to all children of nappy wearing age and little ones who have not been toilet trained for more than a year. All our venues charge a fee for cleaning of the pool which will be passed onto customers who have not adhered to this policy or who child is not suitably attired for swimming. Please note you will be refused entry if you do not have the correct nappies and no refund will be made. 
No nappy bins will be available so please do take these home with you Do not put nappies into normal bins or sanitary bins as our teachers will have to remove these. (Please refer to latest restrictions on use of nappy bins) 


Our Team - Our team are on hand to make your experience enjoyable. There are restrictions which your teacher may need to remind you of from time-to-time, these are in place to ensure your safety and the safety of other users. Swimkidz will not tolerate any threatening behaviour to any member of its team or pool operators and their teams and reserve the right to cancel lessons for any customer whose is deemed to breach this rule. 


Pool/Poolside Health and Safety - Please ensure you and your little one shower before entering the pool, this will ensure the water quality is maintained and is kept clean for all users. Outdoor shoes are not permitted poolside and sometimes not in the changing rooms, it is advisable to bring non-slip flip flops or wear blue overshows or go bare footed. Prams should not be brought into changing rooms or poolside, some venues have designated areas for these, please check your booking information. 
Please do not enter poolside until a few minutes before your lesson is due to start as it can get quite busy and very noisy which is detrimental to the enjoyment of those already being taught. You must not enter the water without being invited to do so by your teacher this includes sitting down on the edge before your lesson commences. At the end of the lesson please vacate safely and do not re-enter the pool at any time. 
Some venues have limitations on the number of people allowed poolside, this includes those in and out of the pool and anyone using other facilities (i.e. members who may be using saunas etc.). 
Due to space in the pool we usually only allow one adult to a child, you are most welcome to change between parents/grandparents etc. Anyone acting as a carer must be 16yrs or above. 


Consistency of Teachers - We will endeavour to keep the same teacher throughout the term but cannot guarantee this in the case of illness of planned time off. We may from time-time introduce additional teachers into the pool, this will be to assist our training program and will not affect the quality of your lessons. 


Exclusion of Liability 1.1 Nothing in this agreement limits any liability which cannot legally be limited, including but not limited to liability for: 
(a) death or personal injury caused by negligence. 
(b) fraud or fraudulent misrepresentation; and 
(c) breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession). 
Subject to clause 1.1, the total liability of Swimkidz Franchise Limited, its franchisees, directors, officers and employees to you shall not exceed five million pounds. Our total liability includes liability in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with this agreement. 


Safeguarding Policy - Swimkidz accept that its main responsibility is for the well-being and safety of those young and vulnerable who swim with us. This is done in the belief that by placing their welfare at the centre of our concerns we are providing a solid foundation for the development of our next generation of swimmers and for effective Child Protection practice. 
Swimkidz has adopted and adheres to the Swimming Teachers Association Safeguarding and Protecting Young People policy, procedures; Good Practice Guidance; and Code of Ethics and Behaviour. Swimkidz is committed to these principles, which include: 
Recruitment, selection and retention of persons with access to young people. 
Criminal records bureau (DBS) checks. 
Anti-bulling; and 
Taking and use of photographic and recorded images of young people. 
It is also recognised that Child Protection is a mutual commitment between teachers and parents / guardians. Notwithstanding the Child Protection procedures laid out below, teachers will work with parents / guardians to develop a mutually beneficial relationship. As part of their training, all teachers have to complete their ‘Safeguarding Children’ online course and will be given regular Child Protection Awareness training. 
The Franchisee will have the responsibility for ensuring that the procedures are carried out in the correct manner. In the event of any incident involving the Franchisee, the Franchisor will act in his/her place wherever possible. At the core of all our procedures is the overriding principle that no child(ren) will be put at any further risk. 


Acceptance & Changes to Terms and Conditions - Terms and conditions may change from time to time, the latest version will be available for you at the time of booking, and we will notify you accordingly of any such changes. If you do not agree with the changes, you must notify us in writing within 14 days. If we do not receive any such notification, it will be deemed you have accepted the latest updated version
